I had the pleasure of speaking with John Bell about a situation with my Dad's trust and having to use the Small Estate Affidavit form and John went through it with me on the phone and simplified it so I understood it. I highly recommend this firm for your estate planning needs, very knowledgeable people.

Without a Properly Funded Living Trust:

Your assets may still go through probate, causing delays, added costs, and stress for your family. We help Arizona families fund their trusts properly so their plans work exactly as intended.

Do I need a trust, a will, or both?

That depends on your goals. A will names guardians for minor children and handles assets that aren’t covered by a trust. A revocable living trust avoids probate, provides privacy, and makes things easier for your loved ones after you pass. Most families benefit from having both. The will acts as a backup, while the trust handles the heavy lifting. Together, they form a complete plan that keeps your wishes in place.

What does “funding a trust” actually mean?

Funding a trust means transferring ownership of your assets into the trust’s name. That includes things like your home, bank accounts, or investment accounts. If your trust isn’t properly funded, your estate could still go through probate, even if the trust was created. We walk every client through this step to make sure their plan actually works when the time comes.

Will my plan still work if I move out of Arizona?

In most cases, yes. Your trust and will are valid across state lines. However, it’s a good idea to review your documents if you move. Laws around probate, taxes, and powers of attorney can vary by state. We recommend a quick check-in to make sure everything still aligns with your new location and local requirements.
